1. Preamble
By accessing and using this Internet portal, whose domain name is www.amf.org.mx,
owned by the Asociación Mexicana de Ferrocarriles, A.C., hereinafter referred to as “AMF” or the “Association,” the user accepts these Terms and Conditions of Use, expressing consent by electronic means pursuant to Article 1803 of the Federal Civil Code.
En caso de no aceptar de forma absoluta y completa estos Términos y Condiciones, el usuario deberá abstenerse de acceder, navegar, consultar o utilizar el sitio web.
El acceso, navegación o uso del sitio web implica la aceptación plena e incondicional de estos Términos y Condiciones vigentes al momento de dicho acceso.
La AMF podrá modificar estos Términos y Condiciones en cualquier momento. Será responsabilidad del usuario revisar periódicamente su contenido.

2. Purpose
These Terms and Conditions govern access to and use of the website www.amf.org.mx, as well as the content, documents, publications, communications, materials, forms, registrations, events, newsletters, and other digital services made available by the AMF.

3. License of Use
The AMF grants the user a limited, non-exclusive, revocable, and non-transferable license to access and use the website solely for lawful informational, personal, institutional, or professional purposes.
El usuario podrá imprimir o copiar información publicada en el sitio únicamente para uso personal o interno, siempre que no altere su contenido ni suprima avisos de propiedad intelectual.
Queda prohibida la reproducción, distribución, publicación, modificación, transmisión, comercialización o explotación total o parcial de cualquier contenido del sitio sin autorización previa y por escrito de la AMF.

4. Use of the Website The user agrees to use the website in accordance with applicable law, good faith, public order, and these Terms and Conditions. The user is prohibited from:
  1. Using the site for unlawful, fraudulent, defamatory, offensive, or harmful purposes contrary to the interests of the AMF.
  2. Altering, damaging, disabling, or overloading the website, its systems, servers, or networks.
  3. Introducing viruses, malicious code, programs, or files that may affect the functioning of the site.
  4. Using AMF content for unauthorized commercial purposes.
  5. Impersonating others or providing false information in forms, registrations, or communications.
  6. Violating intellectual property rights, confidentiality, image rights, personal data, or any third-party rights.
The AMF may restrict, suspend, or block access to the site when it detects improper use or conduct contrary to these Terms.
5. Published information
The information contained on the website is for informational, institutional, trade, and railroad sector dissemination purposes. The AMF strives to ensure that published information is accurate and up to date; however, it does not guarantee that all content is free of errors, inaccuracies, outdated information, or omissions. Opinions, data, documents, or materials from third parties published or linked from the site do not necessarily reflect the official position of the AMF, unless expressly stated otherwise.

6. Forms, Registrations, and Events
When the user provides information through forms, event registrations, contact requests, enrollment, document downloads, or similar mechanisms, they declare that such information is truthful, complete, and up to date.
The user shall be responsible for the accuracy of the data provided.
Participation in events, seminars, meetings, courses, publications, or AMF activities may be subject to additional terms, fees, registration requirements, cancellation policies, or specific conditions that will be communicated in a timely manner.

7. Intellectual Property
The website, logos, trademarks, trade names, designs, texts, documents, photographs, images, databases, newsletters, communications, studies, presentations, graphics, audiovisual materials, and other content are the property of AMF or their respective owners.
Such content is protected by Mexican law and international treaties on copyright, trademarks, and industrial property.

The user does not acquire any rights over the content merely by using the website.
Any unauthorized use may give rise to the corresponding legal action.

8. User-Submitted Content
When the user submits information, comments, documents, proposals, materials, images, files, or any content to the AMF through the website or linked electronic media, they declare that they have the necessary rights and authorizations to do so. The AMF may collect and process the user’s personal data in accordance with its Privacy Notice, available on the website or through the corresponding institutional channels. The user must consult said Privacy Notice to learn about the identity of the data controller, the purposes of processing, the means to exercise ARCO rights, data transfers, and other applicable information.
12. Disclaimer of Warranties
The website is provided “as is” and “as available.” The AMF does not guarantee that the site will operate uninterruptedly, securely, or free of errors, viruses, technical failures, or harmful components. The AMF also does not guarantee that the information published will meet the user’s specific needs or substitute for professional, technical, legal, regulatory, logistical, railroad-related, or any other type of advice.
13. Limitation of Liability
To the maximum extent permitted by applicable law, the AMF shall not be liable for direct, indirect, incidental, special, or consequential damages, loss of information, loss of opportunities, operational disruptions, or any harm arising from:

  2. Errors, omissions, or outdated content.
  3. Technical failures, interruptions, or unavailability of the site.
  4. Viruses, cyberattacks, or disruptions attributable to third parties.
  5. Use of information obtained on the site by the user.
  6. Content, services, or third-party sites linked from the portal.
14. Modifications to the Site
The AMF may modify, update, suspend, remove, or discontinue at any time any content, sections, services, forms, materials, databases, events, or functionalities of the website, without prior notice and without incurring any liability whatsoever.

The failure of the AMF to exercise any right provided for in these Terms and Conditions shall not constitute a waiver of such right nor prevent its subsequent exercise.

21. Applicable Law and Jurisdiction
These Terms and Conditions shall be governed by and interpreted in accordance with the applicable federal laws of the United Mexican States. For any dispute arising from the use of the website, the parties submit to the jurisdiction of the competent courts of Mexico City, waiving any other jurisdiction that may correspond to them by reason of their present or future domicile.
